    • "2010: Auderer was one of several officers who stopped two Mexican immigrants under a false pretext. The officers were caught on camera verbally abusing them and roughly arresting them. One of the officers, Corey Williams, infamously threatened to “skull fuck” the pair. (He’s now the sergeant of crisis response.)
    • 2010: Auderer was one of a dozen officers who savagely beat Brian Torgerson, a mentally ill man, causing permanent brain damage. SPD settled with Torgerson’s family for $1.75 million.
    • 2014: Auderer received another complaint from a woman he arrested, who claimed he sexually harassed her in a holding cell. There was no audio of the incident, so OPA issued a training referral.
    • 2015: Auderer punched and choked a homeless man inside the ER at Harborview Hospital. SPD’s Force Review Board ruled that the force was unjustified, but OPA ultimately cleared him.
    • 2016: OPA investigated Auderer for using force against a Black woman while she was handcuffed. This is prohibited by SPD policy unless there are “exceptional circumstances.” OPA ruled that the force use—which occurred conveniently beyond the view of the in-car video—was “lawful and proper.”
    • 2016: OPA investigated Auderer again for punching a woman in the face. He was cleared of any wrongdoing
    • 2016: Auderer was suspended for four days for taking part in an arrest while on an off-duty ridealong with his brother, who is an officer in another jurisdiction. He violated the person’s Miranda rights & failed to report the arrest to a supervisor.
    • 2018: Auderer was reprimanded for making demeaning, unnecessary comments about a woman’s mental health during a traffic stop."

  • I can see it being wrong to shoot a guy who is brandishing a weapon that cannot effect any harm (a knife inside a car with the doors and windows closed), but a murder charge would require evidence of intent.
  • I think the DA was probably overreaching. Worst case they were intentionally overcharging to get it tossed out. Even if that were the case, it's the DAs fault, not the cop.
  • It's entirely plausible that the cop was unable to process the difference between "He's got a knife" and "He's got a weapon" before acting in self-defense.
  • It's also possible that there is more to the story, but based on that article, this is just the painful side of the necessary.

Asset Siezure

Airports

It's not just for mirror-shaded hillbillies anymore. Feds and major cities are doing asset seizure of money that refuses to prove its innocence at airports now.

But passengers don’t surrender their Fourth Amendment rights against warrantless searches by police just because they’re at the airport, according to multiple legal analysts and court documents.

The DEA officially calls its stops and searches at airport gates “cold consent encounters.” Passengers are free to end the discussion and walk away, according to the DEA, even if they’re unaware of those rights.

A federal judge recently dismissed the lawsuit filed by André and English in part because he said they should have known their stops were consensual and not a detention. The men were free to go even if they felt trapped by police on the jet bridge.

The men have filed a notice of appeal with the 11th Circuit U.S. Court of Appeals.

Others who have been searched at the boarding gate said they felt “coerced,” “pressured” or gave consent “under duress.”

In 2015, the Department of Justice Inspector General told the DEA it should stop causing confusion by referring to the searches as a “secondary inspection.”

“Such terminology creates a risk that travelers will interpret the statement to mean they are required to consent to the encounter, similar to their obligations at a TSA checkpoint,” the IG wrote.

CIA

   A military judge at Guantánamo Bay has ruled a 9/11 defendant incompetent to stand trial after a military medical panel found that the man’s sustained abuse in CIA custody years earlier had rendered him lastingly psychotic.

   ...The five 9/11 defendants were variously subjected to repeated waterboarding, beatings, violent repeated searches of their rectal cavities, sleep deprivation and other abuse while at so-called CIA black sites.

   The CIA says it stopped its detention and interrogation program in 2009. A Senate investigation concluded the abuse had been ineffective in obtaining useful information.
